Special needs trusts, powers of attorney, and other documents with unique language protect the disabled beneficiary, allowing them to utilize government assistance while protecting assets they’ve inherited.

Guardianship/Conservatorship

We recommend a trust containing disability provisions and an updated power of attorney, so your loved ones won’t need to go to court and request a guardianship or conservatorship proceeding if you become incapacitated.

With advanced financial and health care directives that allow you to make decisions ahead of time, your family members don’t have to make those hard decisions about your long-term care needs in a stressful situation. An Alabama judge may or may not select the person you would choose to manage assets on your behalf.

Those deemed by the court as incapacitated, in need of protection from abuse, or unable to provide the basic activities of daily living due to their advanced age or disability may be assigned a Volunteer Guardian who is basically a stranger to the family. Seniors with minimal fixed incomes must be protected from financial abuse and exploitation.
